$100K Recovered for an Uninsured Motorcyclist!

One of the cases we are very proud of is that of a motorcyclist riding in the City of Compton. A pickup truck took a left turn causing a collision with our client. As a result of the accident, the motorcycle rider ended up with a broken neck bone and many other serious injuries.

Unfortunately for the motorcyclist, at the time he didn’t have any type of motorcycle insurance, so he was considered prop 213 which is a law that came out in the late 1990s that restricts uninsured drivers from collecting non-economic damages resulting from a car accident, even if the accident was not their fault.

In other words, if you don’t have insurance when you’re riding a motorcycle all you get is your medical bills and your lost wages. You don’t get anything for pain and suffering plus he had about $30K in Medical Bills and we knew this wasn’t a fare recovery for him and at the same time the insurance company was holding their ground. So we decided to take the case and fight for him. What we did was that we turned around and hired a vocational expert and a nurse consultant that confirmed the fact that the future consequences of our client’s injuries and lost wages would be a significantly higher amount of money. Once we were able to prove this we were able to recover the entire $100K policy limit for the client. We are very proud of this case and the fair and just result that we obtained for the client as it shows that justice can be achieved when you take the right steps. If you were injured in a motorcycle or any type of vehicle accident as a result of someone else’s negligence or distraction, you still have the right to seek compensation.
